Refund Policy
1. Overview
Clear Guardianship has two kinds of fees, and they are refunded differently. The self-help product fee (Tier 1) is charged by Prior Labs, LLC for the software and document product itself. The attorney-tier fees (Tiers 2 through 4) are charged directly by THE PRIOR LAW OFFICE, PLLC (“the firm”) for legal services, and are held in the firm’s trust account until earned. Each is explained below.
2. Tier 1: Guided Packet (Self-Help)
The Tier 1 fee is fully refundable at any time before your document packet has been generated. Once your packet has been generated, the fee is non-refundable, because the product, a completed set of documents assembled from your own answers, has been delivered to you at that point.
To request a refund before your packet is generated, contact us at the address in Section 5. We aim to process eligible refunds to your original payment method within ten business days.
If a technical problem with the Service prevents you from receiving a working packet, contact us regardless of where you are in the process. We will work with you to fix the problem or refund the fee.
3. Tiers 2 Through 4: Attorney Services
Fees for the attorney tiers (Packet Review, Guided Support, and Full Representation) are billed and collected directly by the firm, not by Prior Labs, LLC, and are held in the firm’s trust account until earned. (Depending on how checkout is ultimately built, a portion of these fees attributable to the underlying software and document-assembly product may instead be billed separately by Prior Labs, LLC; either way, no part of the attorney-services fee is ever collected or held by Prior Labs, LLC.) The portion held by the firm is earned only as the corresponding work is completed, under a written schedule set out in your engagement agreement. For example, a portion may be earned when your written review is delivered, and a further portion when each scheduled call is completed.
If you end your engagement with the firm before all of the work described in your engagement agreement is finished, any portion of the fee that has not yet been earned under that schedule will be refunded to you. Your engagement agreement, which you will receive and sign before any attorney tier begins, sets out the specific schedule that applies to your engagement.
Full Representation (Tier 4) works the same way: the fee is held by the firm and earned as work is completed under your engagement agreement, not collected as a lump sum on receipt.
4. Upgrading From the Self-Help Product to an Attorney Tier
The Tier 1 product fee is a separate purchase from any attorney tier. It is refundable before your packet is generated as described in Section 2, and non-refundable afterward. It is not itself refundable or credited toward attorney fees. If the firm offers a discount when you upgrade to an attorney tier, that discount is applied to the firm’s fee at the time you engage the firm, not paid or credited from your Tier 1 purchase. Ask about current upgrade offers when you are ready to move to an attorney tier.
5. How to Request a Refund
Email support@clearguardianship.com with your name, order confirmation, the tier you purchased, and the reason for your request. For an attorney tier, you can also raise a refund or termination request directly with the firm, following the process described in your engagement agreement.
6. Payment Disputes and Chargebacks
If you have a concern about a charge, please contact us first so we can resolve it directly and quickly. Filing a payment dispute or chargeback before contacting us can delay resolution and may affect your access to your account while the dispute is pending.
7. Changes to This Policy
We may update this policy from time to time. If we make a material change, we will update the date on this page. Changes will not reduce the refund rights that applied to a purchase you already made before the change.
